DevSta Challenge – Terms & Conditions
  1. Instructions on how to enter form part of these conditions of entry. By participating, entrants agree to be bound by these conditions.
  2. The promoter is Microsoft Pty Limited, ACN 002 589 460 of 1 Epping Road, North Ryde, New South Wales, 2113.
  3. Entry is open to Australian residents: (a) aged 18 years or over; or (b) who will be aged 18 years or over on or before 23rd October 2008. Employees and their immediate families of the promoter, its retailers, judges, suppliers and associated companies and agencies are not eligible to enter.
  4. The competition commences at 0808 EST Monday, 29th September 2008 and closes at 1716 EST Tuesday, 7th October, 2008.
  5. To enter, entrants must:
    1. Go to www.microsoft.com.au/devsta.
    2. Create a Devsta ID and complete and submit details; Entrants will be required to have a Windows Live™ ID to complete this part of the registration process.
    3. Download Microsoft Visual Studio 2008 – complimentary 90-day trial available at: http://msdn.microsoft.com/en-us/vs2008/products/cc268305.aspx.
    4. Start working on your submission using Microsoft Visual Studio 2008 and the specifications contained in the brief which will be sent to you by e-mail on Monday 29th September 2008.
  6. To be classed as a valid entry, each submission must meet all of the following requirements:
    1. Submission must be built using Microsoft Visual Studio 2008. The use of other Microsoft technologies in conjunction with Microsoft Visual Studio 2008 is also permitted.
    2. Must be a valid and original entry, not previously published or displayed in any media or forum anywhere in the world;
    3. Must use the criteria set out in the brief sent by Microsoft on Monday, 29th September 2008.
  7. All entries are deemed to be received at the time of receipt into the promotion database and not at the time of transmission by the entrant. Any costs associated with entering the competition and accessing the website are the responsibility of the entrant.
  8. Multiple entries are accepted subject to each entry being an original submission.
  9. The promoter reserves the right to verify the validity of the entries (including proof of Australian residence of each entrant) and disqualify any entrant who the promoter believes either has tampered with the entry process or has submitted an entry that is not in accordance with these conditions of entry.
    All valid entries received by the closing date will be reviewed by the judging panel. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the judging criteria to be released Monday 29th September 2008.
  10. First prize inclusions 1. Two tickets to the MIX09 Developer Conference: March 18-20, 2009 in Las Vegas (valued at A$3,000 RRP)which includes A. two return economy class airfares for two people from their nearest Australian capital city to Las Vegas (approximately A$7,000 RRP - price dependent on origin of flight). Flights will leave their nearest Australian capital city on the 16th March 2009 and return on the 21st March 2009. B. 5 nights' twin share accommodation for two at the Venetian Resort Hotel Casino from the 16th- 20th March 2009 (valued at A$3,190 RRP). Travel can only be made at the time nominated by the promoter to ensure attendance at the Las Vegas Mix Developer Conference. Travel arrangements are at the promoter's discretion and dependent on the winner's nearest Australian capital airport. Travel prizes are subject to flight and booking availability. All meals, beverages, extra activities, spending money, transfers and all other ancillary costs (including travel insurance, visa requirements) not expressly provided, as well as obtaining any of these, are the responsibility of the winner. In the event that, for any reason whatsoever, the winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.   16. All prizes are not exchangeable, transferable or redeemable for cash. If the promoter is unable to supply the nominated prize, the promoter reserves the right to supply another prize of greater or equal value.
  17. The prize may be subject to the conditions of entry of third party suppliers and the promoter and its related bodies corporate are not responsible or liable for any direct or indirect result of the conduct of the third party supplier.
  18. The stated prize value is the recommended retail value (including GST) in Australia as provided by the supplier and is correct at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prize. The Promoter and its associated agencies and companies accept no responsibility for prizes damaged or lost in transit.
  19. Tax implications may arise from the prize winnings. Independent financial advice should be sought.
  20. All entries become the property of the promoter. The promoter's decision is final and no correspondence will be entered into. No responsibility is accepted for entries not received by the promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way. By entering this competition, you agree to grant the promoter a non-exclusive, non-transferable, royalty free license throughout the world, in your entry including all media now existing or subsequently devised, in perpetuity to the promoter (regardless of whether or not your entry is selected as a finalist or winner) for the promoter to do any and all of the acts now or subsequently comprising the copyright (and all other intellectual property rights) in the entry for the purposes of conducting this competition and for future promotional purposes without any further compensation to you including but not limited to displaying and making available for download (to any third party) your entry on the DevSta website.
  21. Winners of all prizes will be announced on the DevSta website at www.devsta.com.au on the 29th October 2008.
  22. In the event that a prize is not claimed the judges will select an alternate winner to receive the prize.
  23. Subject to any applicable law which cannot be excluded, the promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.
  24. Before the prize is awarded, the winner and any other person sharing the prize with the winner will be required to sign a form to release the promoter from and indemnify the promoter against, any and all liability arising from the use or participation in the prize.
  25. Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for publicity purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described throughout these terms. Entrants may access and/or change their data by following the procedures in the promoter's privacy policy which is available at www.microsoft.com/australia/privacy. The promoter will only use your personal details for marketing purposes outside those described above if you "opt in" to join the mailing list when prompted.
  26. The promoter assumes no responsibility for, and the entrant releases the promoter from responsibility for, any failure to receive an entry or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the entrant's participation in this promotion or the conduct of the promotion generally or as a direct or indirect result of an entrant's error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted as planned and/or the promotion's administration, security, fairness or integrity are compromised or affected, the promoter may cancel, terminate, modify or suspend the promotion and/or disqualify any entrant involved in interfering or tampering with the conduct of this promotion in any way.
